These Terms of Service ("Terms") govern your access to and use of BrushLens (brushlens.app), operated by SU Studio (CVR: 46441311), Denmark. By creating an account or making a purchase, you agree to these Terms. How we handle your data is described in our Privacy Policy.
BrushLens is a web-based tool that helps oil painters analyze reference photos. The service runs in your browser and processes images locally on your device. We provide access to a set of analysis tools via a subscription or one-time purchase.
You must be at least 16 years old to use BrushLens. By using the service, you confirm that you meet this requirement.
You access BrushLens by signing in via email magic link, Google, Facebook, or Patreon. You are responsible for keeping your account secure and for all activity under your account. Notify us immediately if you suspect unauthorized access.
Patreon sign-in is available to members of the Studio Pass Patreon membership. Patreon access is managed through Patreon and ends when your Patreon membership ends. Sections 4 and 5 below apply to subscriptions and purchases made directly through BrushLens.
All prices are in USD. Local taxes may be added at checkout depending on your location, and the total including tax is shown before you confirm. Payment is processed by Stripe. We never see or store your card details.
Charges from BrushLens appear on your bank or card statement as BRUSHLENS. The first charge after a free trial is marked with an additional one-time trial notice. If you see a charge you do not recognise, please email us before contacting your bank - see section 6.
Monthly and yearly subscriptions include a 7-day free trial. Your payment method is authorised at signup but not charged during the trial. When the trial ends, the plan you selected begins automatically and your payment method is charged the price shown at checkout. The exact conversion date is displayed at checkout before you enter your payment details.
We send you an email reminder before the trial converts, to the address on your account. You may cancel at any point during the trial to avoid being charged, at no cost and with no explanation required.
The Lifetime plan does not include a free trial. It is charged in full at the time of purchase.
Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from your account page in the app, which opens the Stripe customer portal, or by emailing hello@brushlens.app. Cancellation takes effect at the end of the current paid period: your access continues until then, after which it ends without further charge. We send a reminder email before an annual subscription renews.
If a renewal payment fails, Stripe will retry the payment for approximately 21 days. During this grace period, your access continues. If payment is not recovered, your subscription will be cancelled and access will end.
Under EU consumer law, you have a 14-day right of withdrawal on your first purchase of a subscription. Because BrushLens is a digital service supplied immediately, this right may lapse once you have started using the service, under the digital content exception in the Consumer Contracts Directive.
In practice we apply the following, which is at least as favourable to you:
For refund requests, email hello@brushlens.app from the address on your account. We aim to be reasonable in cases of genuine dissatisfaction, including outside these windows.
If you do not recognise a charge, believe you have been charged in error, or have any other billing question, email hello@brushlens.app. We read every message and aim to reply within two business days.
Contacting us first is almost always faster than raising a dispute with your bank: we can usually cancel and refund the same day, whereas a bank dispute takes weeks or months to resolve for both of us. Raising a dispute does not remove your right to a refund under section 5, and we will not restrict your account for asking.
You agree not to:
Violation may result in termination of your access without refund.
BrushLens and its content, design, and code are owned by SU Studio. You receive a personal, non-transferable, non-exclusive licence to use the service while your subscription is active or, for lifetime purchases, for the lifetime of the product.
You retain all rights to your reference photos and the analyses you produce.
We aim to provide reliable access but cannot guarantee uninterrupted service. We may perform maintenance or updates that temporarily interrupt access. We will not be liable for downtime, though we will make reasonable efforts to minimise it.
The "Lifetime" plan grants access for the operational lifetime of BrushLens as a product. We commit to operating BrushLens in good faith for as long as practical. If we shut down BrushLens, we will provide at least 60 days' notice to lifetime customers and refund a fair proportion based on time elapsed, at our discretion.
To the extent permitted by law, SU Studio's total liability for any claim arising from your use of BrushLens is limited to the amount you have paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages. Nothing in these Terms limits liability that cannot be excluded under Danish or EU law, including your statutory rights as a consumer.
You may terminate your account at any time. We may terminate or suspend your access if you materially breach these Terms, with notice where reasonably possible. Upon termination, your right to use the service ends, but provisions that should reasonably survive (payment obligations, intellectual property, liability) continue.
We may update these Terms from time to time. Material changes affecting your rights will be communicated by email at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance. Price changes never apply to a period you have already paid for.
These Terms are governed by Danish law. If you have a complaint we have not resolved, please email us first. Consumers in Denmark may bring the matter to Naevnenes Hus, Toldboden 2, 8800 Viborg (naevneneshus.dk). Consumers elsewhere in the EU may use the complaint bodies available in their country of residence. Disputes that cannot be resolved otherwise are subject to the jurisdiction of the Danish courts, and EU consumers retain their right to bring proceedings in their country of residence.
